1. Acceptance of Terms
By accessing or using DermLabs (“the Service”), operated at dermlabs.co, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
DermLabs is a free, informational tool that analyses skincare ingredient lists for potential concerns including comedogenicity (pore-clogging risk), fungal acne triggers, pregnancy caution flags, and irritation risk. The Service allows users to paste ingredient lists or upload label photos for analysis.
3. Not Medical Advice
The information provided by DermLabs is for educational and informational purposes only. It does not constitute medical advice, diagnosis, or treatment. The Service is not a substitute for professional medical advice from a qualified dermatologist, physician, or other healthcare provider.
You should not rely solely on information provided by the Service to make decisions about your skincare routine, especially if you have existing skin conditions, allergies, or are pregnant or nursing. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition or skincare concern.
4. Accuracy and Limitations
While we strive to maintain an accurate and up-to-date ingredient database, DermLabs makes no warranties or representations regarding the completeness, accuracy, reliability, or suitability of the information provided. Ingredient safety data is based on publicly available research and may not reflect the most current scientific findings.
The comedogenic ratings, fungal acne flags, pregnancy caution flags, and irritation assessments are general guidelines. Individual reactions to ingredients vary significantly based on concentration, formulation, skin type, and other factors. A flagged ingredient does not guarantee an adverse reaction, and an unflagged ingredient does not guarantee safety for all users.
OCR (optical character recognition) for uploaded label photos may produce errors. Users are responsible for reviewing and correcting extracted text before analysis.
5. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to interfere with, disrupt, or overload the Service or its infrastructure.
- Use automated scripts, bots, or scrapers to access the Service without prior written permission.
- Reverse engineer, decompile, or attempt to extract source code from the Service.
- Misrepresent the Service’s analysis results as professional medical or dermatological advice.
6. Intellectual Property
All content, design, graphics, logos, and software associated with DermLabs are the property of DermLabs and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without prior written consent.
The ingredient database, analysis algorithms, and educational content are proprietary to DermLabs.
7. Uploaded Content
When you upload label photos for OCR processing, the images are processed on our servers solely for the purpose of text extraction. We do not store uploaded images beyond the time needed to complete the OCR process. You retain all rights to any content you upload.
8. Limitation of Liability
To the fullest extent permitted by applicable law, DermLabs and its operators, contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
In no event shall the total liability of DermLabs exceed the amount you have paid to use the Service (which, as a free service, is zero). This limitation applies regardless of the legal theory on which the claim is based.
DermLabs shall not be held liable for any adverse skin reactions, allergic responses, health complications, or other damages resulting from decisions made based on the Service’s analysis or information.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of information.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
10. Indemnification
You agree to indemnify, defend, and hold harmless DermLabs, its operators, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of another party.
11. Third-Party Links
The Service may contain links to third-party websites or resources. DermLabs is not responsible for the content, accuracy, or practices of any third-party sites and does not endorse them. Your use of third-party sites is at your own risk.
12. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
13. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
